Crypto Legal Status
Crypto is currently unregulated in South Africa. However, crypto is a financial product, in terms of the Financial Advisory and Intermediary Services Act 37 of 2002 ("the FAIS Act"). Financial services for crypto assets became regulated in South Africa during 2023. Crypto asset service providers ("CASPs") are accountable institutions, in terms of the Financial Intelligence Centre Act 38 of 2001 ("the FICA"), and are financial services providers ("FSPs"), in terms of the FAIS Act.
